If the program is designed to provide rehabilitative training, there's no reason the same services cannot be provided by the county under terms of the Americans with Disabilities Act, he said. Special circumstances Ka Lima Executive Director Jamie Woodburn said the program differs from contracts awarded to private companies because its clients cannot compete for work on the job market.

They can learn to do a job, but they need more supervision and training. Ka Lima clients have difficulties a private business would not accept in a worker. Yet "we have always tried to provide real work experience in a real work setting," Woodburn said. He hopes the state Legislature will act next year to allow private contracts to programs such as Ka Lima under the Supreme Court ruling. The court left it to the Legislature to define what kind of contracts are allowed.

In the last legislative session, a Senate bill proposing a moratorium on private contracts specifically excluded contracts such as Ka Lima's with Maui County. The bill failed, as did a House bill that would have allowed a Ka Lima contract. to said MILDRED S. H. 31 36, Honolulu Harbor.

The objection is not aimed at the programs Ka Lima provides, said UPW Director Gary Rodrigues. Rather, the union wants to ensure that the Ka Lima workers are being compensated fairly for the work they perform. "Once we discover what's really happening, then we can decide what we should do," Rodrigues said.

"If someone has been doing the same work for 10, 20 years, what are they getting paid? What hours are they working? If they're doing county work, why aren't they hired by i he county?" "It gives them pride and they feel that they're contributing to the community," one woman said. "They feel that they are useful individuals." The UPW is raising questions over a $700,000 Maui County grant to the agency under the Hawaii Supreme Court ruling that counties cannot contract out work "traditionally and historically" handled by civil service workers. There are things that you pay to do, and there are free as lectures and tours operated by the Fish and Wildlife Service staff on Midway. During the first year, Midway Phoenix was limited to 30 visitors at a time, since the Navy was still conducting its environmental cleanup programs. Now, the number has jumped to 100 visitors. With staff, wildlife officials and others, the total population can run to 250 at a time. That's still not many when compared with the several thousand sailors at a time who were on the island during World War There is no proposal for expanding the number of visitors beyond 100, but under the new public use program, the service proposes to allow them a few more things to do.

Among these: Catch-and-release fishing from shore, with artificial lures only, and with barbless hooks. Night diving and night fishing would be allowed. Lobstering year-round in the lagoon, with a limit of one lobster per person, to be eaten while on Midway, Lobstering would be allowed only while snorkel diving, not with scuba gear. A glass-bottom boat in addition to the fishing and diving boats now available to visitors. There would be guided kayak tours.

The major impact of the. expanded recreational opportunities would be about 20 new jobs, raising the. number of nontourists on the island from 150 to 170, according to a draft supplemental environmental assessment for the project. She said the service's goal is to let people experience the rich natural environment of Midway, not simply to provide a nice vacation spot.

"Even the kayaking will be a very structured plan where people will have to go out with a guide in groups," she said. With the nearest hospital (and the Coast Guard) more than 1,000 miles away, the safety of visitors is a serious concern, she said. The Fish and Wildlife Service signed a contract with Midway Phoenix Corp. to manage the island and run the ecotourism operation.
